Fearless Track: Waiver

PLEASE READ CAREFULLY – THIS IS A LEGAL AGREEMENT. BY AGREEING, YOU ARE WAIVING CERTAIN LEGAL RIGHTS.

By selecting registering for Fearless Track Club you acknowledge and agree to the following on behalf of yourself and your minor child participating in any activities, events, practices, or programs operated by Fearless Track Club Foundation (“FTC”):

By accessing, registering for, or allowing a child to participate in Fearless Track Club Foundation activities, the parent or legal guardian acknowledges that participation in youth athletic activities, including but not limited to track and field, conditioning, games, drills, and related activities, involves inherent risks.

These risks include, but are not limited to:

• Slips, trips, and falls
• Collisions with other participants or objects
• Muscle strains, sprains, or fractures
• Heat exhaustion, dehydration, or weather-related illness
• Injuries arising from equipment or playing surfaces

The parent or legal guardian understands and accepts that these risks may result in serious injury, illness, or death and voluntarily assumes all such risks, both known and unknown, whether or not caused by the negligence of Fearless Track Club Foundation or others.

On behalf of myself and my child, I hereby release, waive, discharge, and covenant not to sue Fearless Track Club Foundation, its directors, officers, coaches, volunteers, staff, sponsors, partners, and affiliates (collectively, “Released Parties”) from any and all claims, liabilities, damages, or causes of action arising out of or related to:

• Personal injury
• Illness or medical conditions
• Death
• Property damage or loss

whether caused by negligence or otherwise, to the fullest extent permitted by law.

I agree to indemnify, defend, and hold harmless the Released Parties from any claims, demands, damages, costs, or expenses (including attorneys’ fees) arising out of my child’s participation in FTC activities.

I authorize FTC and its representatives to obtain emergency medical care for my child if necessary. This includes:

• Contacting emergency services
• Administering basic first aid
• Transporting my child for medical treatment

I understand that I am solely responsible for any medical costs incurred.

I confirm that my child is physically able to participate in athletic activities and has no condition that would make participation unsafe, except those I have independently disclosed to FTC prior to participation. I acknowledge that FTC does not provide medical evaluations.

I understand and agree that:

• My child is expected to follow all instructions from coaches and staff
• Unsafe, disruptive, or disrespectful behavior may result in immediate removal from activities
• No refunds are guaranteed in the event of dismissal due to behavior or non-compliance

I grant Fearless Track Club Foundation permission to capture and use my child’s name, image, likeness, voice, and participation in:

• Photos
• Videos
• Marketing materials
• Social media and promotional content

I understand that this content may be used without compensation and may be distributed publicly.

I understand that:

• FTC does not provide transportation
• I am responsible for my child before and after scheduled program times
• FTC is not responsible for incidents occurring outside of official supervised activities

I acknowledge that activities may take place in various weather conditions, including heat, humidity, or rain. I accept all risks associated with environmental conditions and understand that FTC may modify or cancel activities at its discretion.

I understand that participation may involve the use of public or private facilities and equipment. I accept all risks associated with these environments and acknowledge that FTC does not control all conditions of such facilities.

I understand that FTC makes no guarantees regarding:

• Athletic performance or results
• Skill development outcomes
• Safety beyond reasonable precautions
